The operator of Spokane County痴 West Plains racetrack owes $20,000 in back payments to the county and more than $1 million to contractors who have been refurbishing the facility, county officials say.

County Executive Marshall Farnell confirmed Monday that Bucky Austin, the track痴 operator, has missed two monthly payments of $10,000 each, which are required under the terms of the lease announced last fall.

The county asked Austin to 途esolve the lease payment problem that is, make the payments he owes last week, Parks Director Doug Chase said. If he doesn稚 make the payments, Austin could be served notice that he痴 in breach of contract, and his lease could be eventually terminated.

But any such action is down the road, Chase said.

Spokane County Commissioner Mark Richard said he was concerned about the missed payments to the county but wants to hear more from county staff after they meet with racetrack officials. 的 have a lot of respect for Bucky and his team, Richard said.

Austin owns a chain of auto repair shops in the Puget Sound area, but he operates the racetrack under a separate limited liability corporation. Efforts to reach Austin or track manager Jay Livingston for comment were unsuccessful Monday.

Commissioners will not meet this week because of vacation schedules, but county staffers hope to set up a conference call by midweek to include Austin, his track manager and financial advisers and county parks, purchasing and legal staff.

County officials have been notified that Austin also has at least two unpaid bills for work at the county-owned facility.

Chief Civil Deputy Prosecutor Jim Emacio said the county has been notified of an unpaid bill of $768,471.39 from William Winkler, a concrete company, and another of $294,942.19 from T.W. Clark, a general contractor.

Representatives of both companies could not be reached for comment Monday.

The county isn稚 aware of all the terms of the agreements between Austin and contractors working at the racetrack, so it hasn稚 reached a conclusion about the debts, Emacio said. There may be other unpaid bills as well, from contractors who have not yet notified the county, he added.

One other contractor who said he has not yet been paid for all his work at the track is John DePaolo, owner of DePaolo Painting. He said Monday he had only been paid for about half the work he has done at the track and is still owed about $24,000 that was billed at the end of April, with payment due by the end of May.

After the partial payment, track officials promised the remainder 妬n a couple of weeks, after a big event, DePaolo said.
DePaolo said he talked to Livingston, the track manager, 鍍hree or four weeks ago about the debt. At the time, Livingston wanted DePaolo to do more painting, and the contractor asked when he was going to be paid for past work.

的 haven稚 heard from him in three weeks, DePaolo said.

The painting contractor said he contacted the county about the debt but 鍍hey couldn稚 give me an answer. He was waiting to see what action larger firms, such as Winkler and Clark, would take.

Contractors should notify the county of such problems, Emacio said: 徹bviously, the county痴 interested in what痴 going on at the racetrack.

TW will be able to deal but DePaolo is a smaller company and right now the way the comercial painting market is, this might be hurting them pretty good.

So did they didn't have a plan at all for making those payments in advance? Just hoping to drag them out till they starting making money from events? Sounds like a great business plan to me ;)

All i can say is get out there and enjoy the track while it is still open because who knows what will happen in the future

the website shows 5/1/09 as the first passes down the track.. So he hasnt paid since the track has been making money.. Thats weird.. maybe since he travels and races its hard for him to make said payments.. But really, electronic transfers are simple..

Im not bashing, Jay does a great job! Just kinda weird how things are panning out.. News said 10,000 attented the last event (Lucas Series).. Well at even $10 a person the bills to the county should be paid..

the sky is falling! I doubt bucky is a dead beat or a scam artist. yeah the bills should be payed on time, especially the contractors. dont know why, will see. 10,000 spectators at the div6 race? doubt it. not what I saw in the stands, maybe 1000. weak turnout for three days.

I agree. I was only there Sat. though. Even with that said, the stands weren't packed like I feel like they should've been for the caliber of event this was.

After talking to a freind who deals with "Big Business" of this nature. In such high amounts of money its common for a 60-90 day turn around. The news had said that redicules amount of people. I watched all the news posts online because I was in most of them!

All in all I really doubt there is anything to worry about. This article may have been a bit early, and that Farnell guy was maybe a bit out of line by putting the county's finances out to the public before the actual problem..

First thing the review will always talk about is the negative. I have never read anything they published that was positive about bucky buying the track. I think they didn't like the fact the county spent so much money on the track. All they could talk about was how many people were upset when they bought it not how many people were happy that we finally have a track that will be taken care of and run professionally. Like I always said to myself when I heard all the rumors of the track shutting down when Moe owned. I will believe it when I see it and all is have to say is piss on the spokesman review.

i totaly agree...im not gonna believe any shit until i see it....there probably was some lame ass reporter out there that was on the brink of getting laid off and couldnt find a better story to write about....

I agree big business with big money sits on it for a time. the interest on 1 million for just 90 days has got tobe enough to pay the rent. and for the spokesman jumping the gun making a story out of nothing to sell papers, doesnt surprise me. how far behind is the city and county on paying its bills?

Oh absolutely 3 to 5 months is normal for contractor COMPLETE payments as in Retainage, but not monthly invoicing. Yes Liens are common but the real problem is the negative attention this brings to an already controversial tax payer funded county purchase.

If the county is stupid they will continue to make this news. bucky and jay have been in the northwest all there lives. they are both respected individuals, this is a bullshit story. Its like the crap about the contaminated water, the paper made it sound like it was the racing that caused it. I believe in bucky and jay, theres no problem here. people will be paid im sure.

Only thing i see thats bad, and this is if the article is 100% accurate....is that there is no communciation between Bucky/Jay and the county and contractors. Seems like they just want to know whats going on and that they'll get paid....and with contracted big work this is nothing out of ordinary.

this has been an attempt to publicly embarrass bucky, its wrong and I for one believe in bucky and this track. as for the contractors, Im sure this is not there first big job and are able to take care of getting paid.

The water is all fixed. I ran it through my britta filter jug, one gallon at a time and the aquifer is pure as the driven snow again.

If I recall, from owning a small business, even the Feds expect you to lose money on your business for the first two years. Banks can loan you money you do not have to repay for two to three years so being a little late on payments, this early, is no biggy (big picture). Imagine looking back on this in twenty years and saying "Yeah, the manager was half a mil behind, two months into the racing season, twenty years ago."

Your audience might be like "And.....?"

Someone mentioned that all the bills are now paid but the track is a whole month behind. (I can't remember who told me that!!!!) It will take more events to fill the books but has anyone heard any advertisements for the track or any events? I haven't but I've been listening to an Irish drinking song CD every day, not the news.

i've heard advertisements about the track and friday night racing on 94.5. Also saw some commercials about the lucas oil event the day before and the day of the event on the speed channel.

That's right, 94.5 has been there all season, I think. I almost never listen to that station though :(
