Myspace.com, an internet site popular among teenagers, is being sued by a 14-year-old Texas girl who says she was sexually assaulted by a man claiming to be a high school senior on his school's football team.
Instead, Pete Solis was a 19-year-old who picked the girl up at school, took her to dinner and a movie, then drove her to an apartment complex parking lot, where the assault took place. Now the girl is suing Myspace for $30,000,000; saying the web site does nothing to verify the ages or identities of those who chat on the site and send emails to other site members.
The girl's attorney says the lawsuit is the first of its kind, and it claims that the social networking site does nothing to protect its members from sexual predators. The lawsuit also includes news stories about other cases where young girls were contacted by men more than twice their age, who claimed to be teenagers, and then sexually assaulted the girls after they agreed to meet the men. In one case, a 22-year-old Wisconsin man was charged with six counts of assult against a 14-year-old girl. In another, a 27-year old connecticut man was charged with assaulting a 13-year-old girl. Although Myspace has a "Tips for Parents" page which states that users must be 14 or older, no proof is required to verify members ages.
Myspace officials say that the site takes "aggressive" measures to protect members. The site is the third most viewed internet site in the world, with 80 million members.
Attorney Generals from Texas and four other states have already asked Myspace to tighten their security measures, using such tactics as requiring users to identify themselves and their ages with a credit card or valid email account. The precident-setting lawsuit will help determine whether a web site is legally responsible for activity that occurs away from the site."
